The Sultanate of Oman occupies the south-eastern comer of the Arabian Peninsula. It borders Saudi Arabia and the United Arab Emirates in the west, the Republic of Yemen in the south, the Arabian Gulf, Gulf of Oman and the Arabian Sea. In 1971, the Sultanate of Oman, previously known as Muscat, became a member of the United Nations and the Arab League.

Trademarks are acceptable for registration in accordance with the Law No. 103/88.

The period of trademark registration is for ten years, renewable for similar periods. The Trademark Law in Oman allows a three-month grace period for late trademark renewals. However, such late trademark renewals are usually subjected to a late payment fine.

At present, there is no statutory law for the protection of patents and designs in Oman. It is, however, advisable to publish Cautionary Notices in the local Arabic and English newspapers in order to protect owners' rights.

FILING REQUIREMENTS


TRADE/SERVICE MARK REGISTRATION
  1. Power of Attorney signed by the applicant and duly legalised up to the Oman Embassy in the country of the applicant.
  2. A Certified copy of the certificate of Incorporation of the applicant company, and an extract of its entry in the Commercial Registry, or a good standing certificate if all relevant information is included in such a document. (For U.S. clients, a certificate of good standing is sufficient).
  3. Twenty prints of the trademark identical to the one affixed on the application for registration.
  4. Full name & address of the applicant.
  5. A clear statement of the goods & classes to be covered and colours to be protected by the trademark.
PATENT REGISTRATION
  1. Power of Attorney signed by the applicant and duly legalised up to the Oman Embassy in the country of the applicant.

RECORDAL OF AN ASSIGNMENT
  1. Power of Attorney signed by the applicant and duly legalised up to the Oman Embassy in the country of the applicant.
  2. A Deed of Assignment form, signed by both the Assignor and the Assignee, duly legalised up to the Oman Embassy in the country of the applicant..
  3. An Extract of the entry of the Assignee company in the Commercial Registry.
     
RECORDAL OF CHANGE OF NAME/ADDRESS
  1. Power of Attorney signed by the applicant clearly showing the change of name or address and duly legalised up to the Oman Embassy in the country of the applicant.
  2. A certificate of change of name or address duly legalised up to the Oman Embassy in the country of the applicant.

PATENTS & DESIGNS

  1. At present the Trademark Law in Omen does not provide protection for either patents or designs. Nevertheless, it is advisable to publish Cautionary Notice
