The United Arab Emirates is located to the middle of the Arabian Gulf. It borders the Arabian Gulf to the north, to the west it borders the State of Qatar and the Kingdom of Saudi Arabia, to the south it borders the Sultanate of Oman and the Kingdom of Saudi Arabia, and to the east it borders the Gulf of Oman. The United Arab Emirates was officially formed in December 1971. Moreover, the United Arab Emirates is a federation that comprises of seven emirates (states): Abu Dhabi, Dubai, Sharjah, Ras Al Khaimah, Fujairah, Ajman and Umm Al Quwain.

Under the Ras Al Khaimah Trade Mark Act 1974 issued by the Chamber of Commerce, trade/service marks registrations were being processed through the Ras Al Khaimah Trade Mark Office. However, when the new Federal Law No. 37 was introduced in 1992, with respect to trademarks in the United Arab Emirates, and which came into force on 13 January 1993, no further filing actions were to be assigned to Ras Al Khaimah Trade Mark Office. As a result, registrations that were processed by the former Trade Mark Office in Ras Al Khaimah, were considered ineffective and thus, such registrations should be re-registered with the Trade Mark Office of the Ministry of Economy and Trade in Abu Dhabi. However, those certificates of registration which were issued by the Ras Al Khaimah Trade Mark Office, may be used to claim priority for new applications to be registered with the Abu Dhabi Trade Mark Office.

FILING REQUIREMENTS IN UAE
 
TRADE/SERVICE MARK REGISTRATION
  1. Power of Attorney signed by the applicant and duly legalised up to the UAE Embassy in the country of the applicant.
  2. A specification of class, goods to be covered and colours to be protected by the trademark.
  3. Full name & address of the applicant.
  4. Twenty prints of the trademark identical to the one affixed on the application for registration.
PATENT REGISTRATION
  1. Power of Attorney signed by the applicant and duly legalised up to the UAE Embassy in the country of the applicant.
  2. A copy of the original Assignment or the Deed of Assignment from the inventor(s), duly legalised up to the UAE Embassy, clearly showing the name of both the Assignor and the Assignee.
  3. A copy of the certificate of Incorporation or an Extract of the entry of the Assignee in the Commercial Registry.
  4. A certified copy of the home application may be required for claiming priority.
RECORDAL OF RENEWAL
  1. Power of Attorney signed by the applicant and duly legalised up to the UAE Embassy in the country of the applicant.
  2. The original registration certificate of the trademark is required for endorsement purposes.
RECORDAL OF AN ASSIGNMENT
  1. Power of Attorney signed by the Assignee and duly legalised up to the UAE Embassy in the country of the applicant.
  2. A Deed of Assignment signed by both the Assignor and the Assignee and duly legalised up to the UAE Embassy in the country of the applicant.
  3. A copy of the certificate of Incorporation or an Extract of the entry of the Assignee in the Commercial Registry and duly legalised up to the UAE Embassy in the country of the applicant.
RECORDAL OF REGISTERED USER/LICENCE
  1. Power of Attorney signed by the applicant and duly legalised up to the UAE Embassy in the country of the applicant.
  2. The Licence Agreement signed by the concerned parties and duly legalised up to the UAE Embassy in the country of the applicant.
  3. A copy of the certificate of Incorporation or an Extract of the entry in the Commercial Registry.

RECORDAL OF CHANGE OF NAME/ADDRESS
  1. Power of Attorney signed by the Assignee and duly legalised up to the UAE Embassy in the country of the applicant.
  2. A certificate clearly showing the change of name or address duly legalised up to the UAE Embassy in the country of the applicant.
