Intellectual Property Protection (IPP)
Recent years have witnessed an increase in brand infringements by imitations imported from the newly industrialized nations. These imitations have begun to capture a significant market share due to the similarity in name and packaging to the originals they simulate, and their price advantage. Importers and local agents of internationally recognized brands have found that their businesses are suffering as a result of increasing competition from precious products. Such importers and local agents are not aware of the protection provided by legalization that prevents the importing of counterfeit goods. In these circumstances it has become imperative that the owners of well-known brands protect their interest by registration of that interest or by the publication of Cautionary Notices.
Trademarks
Trademarks are signs which are used to distinguish the goods or services of one business from those of another. In this context, the word “sign” is used very broadly. Although most trademarks are words or logos or combinations of the two, other forms such as three- dimensional shapes, combinations of colours and even sounds may be, and indeed are, used as trademarks.Trademarks can be considered as essentially indications of the origin of a particular product or service. The formulation or make-up of many products sold under a particular trade mark may well vary as time goes by, but the trademark will remain unchanged. Trademarks are a most important means of protecting the reputation and goodwill that a business has built up. The reputation and image of most products and services is a result of a whole range of different factors such as quality, customer satisfaction, availability, advertising, competition and so on. However, whatever has gone into the creation of the reputation or image it is invariably encapsulated in the mind of the customer, or end-user, by the trademark
Intellectual Property Registration
We work with clients to check the viability of the trademark, patent or design within the required jurisdiction; negotiating with other mark agents to resolve potential conflicts. We assist clients in compiling the required documentation (including definition and, where appropriate, proof of foreign registration). We then handle the authorization process directly with the authorities to ensure that the registration happens quickly and smoothly.
Advantages of Trademark Registration
Trademark registration offers several benefits, including legal protection against infringement, exclusive rights to use the trademark in commerce, increased brand recognition and reputation, and the ability to license or sell the trademark for financial gain. Additionally, trademark registration can serve as a valuable asset for the business and can provide a strong foundation for building a successful brand.
Copyright
Copyright is a protection that covers published and unpublished literary, scientific and artistic works, whatever the form of expression, provided such works are fixed in a tangible or material form. Copyright laws grant the creator the exclusive right to reproduce, prepare derivative works, distribute, perform and display the work publicly.
Design
A significant amount of work may be involved in producing a design, and it is therefore important wherever possible to provide protection for this design work. Design protection is very important in preventing competitors from using the same or closely similar design. A design can be referred as the appearance of the whole or part of a product resulting from features such as the lines, contours, colours, shape, texture or materials of the product or its ornamentation. Such products can include graphic symbols, screen displays, logos, typefaces and packaging. Accordingly, the scope of what is meant by “a design” is very broad.
Patents
Patents protect inventions by giving the owner of the patent the right to stop anyone from making or using the invention without the owners’ permission. This right, granted by the Patent Office, is enforceable in a court of law. A patent can last for up to 20 years. In other words, a patent is a right to stop competition for the invention for a limited period. This right to stop competition exists only in the country for which a patent has been granted.
Domain Names
Domain Names are the internet brands or internet addresses that are commonly used to find websites. For instance, the domain name gulf-ip.com is an internet address of Gulf Intellectual Property and is used to locate its website at www.gulf-ip.com. Our services cover a wide range of domain name registration, renewal and transfer services for gTLDs (generic top-level domains such as .com, .net and .org) and ccTLDs (country code top level domains such as .bh for Bahrain, .kw for Kuwait and .ae for United Arab Emirates).
Utility models
Utility models are registered rights which confer exclusive protection upon technical inventions. As in the case of patent protection, the technical inventions to be protected must possess novelty and involve an inventive step (frequently, the level of inventiveness required is not as great as in the case of patents). Unlike patents, utility models are granted without a prior search to establish novelty and inventive step. They are, therefore, protection rights which can be obtained more swiftly and cheaply, but which also offer less legal certainty. Utility model protection at present exists only at national level
Assignment of Interest/Usage
Where a client wishes to authorize or license an agent or other party to use a registered property, we assist in reviewing the agreement. Once a legally sustainable agreement is reached, we undertake the registration of that assignment, including, where appropriate, the translation and notarization of any documents before registering these with the relevant authority.
Infringement Watch
Once an intellectual property has been registered in a jurisdiction, we monitor the applications for registration as well as Cautionary Notices. This enables us to advise our clients of potential infringements and to intervene on their behalf to protect our clients’ interests.
Anti-counterfeiting actions
We undertake anti-counterfeiting actions for our clients if their trademarks are infringed or violated. Such actions include registering of complaints with the concerned authorities, filing of the civil and if necessary, criminal proceedings before the court of competent jurisdictions and initiating actions seeking confiscation of counterfeited goods and the compensation for the actual loss occurred.
